Chapter 190, ZONING

 

ARTICLE III, District Regulations

§ 190-7. Enumeration of districts. [Amended 5-30-1991 by L.L. No. 10-1991; 4-20-1992 by L.L. No. 1-1992; 6-15-1998 by L.L. No. 4-1998; 7-16-2001 by L.L. No. 4-2001]

For the purposes of this chapter, the Village of Honeoye Falls is hereby divided into 14 classes of districts as follows:

Residential Districts

R-1 District: One-Family Residence

R-2 District: One- and Two-Family Residence

RA District: Apartment Residence

RC District: Retirement Community

RM District: Mixed Residence

RM-G District: Mixed Residence Gateway

TV District: Traditional Village

Nonresidential Districts

SC District: Shopping Center

VB District: Village Business

GC District: General Commercial

IP District: Industrial Park

TV District: Traditional Village

LI District: Light Industrial

MULICD District: Mixed-Use Light Industrial Commercial

§ 190-8. Purpose.

  1. The boundaries of each of the districts listed in § 190-7 are hereby established as shown upon the duly adopted Zoning Map, which accompanies this chapter and which, with all notations, references and other matters shown thereon, is hereby declared a part of this chapter.EN
  2. The district boundary lines, unless shown otherwise, are intended generally to follow street center lines, railroad right-of-way boundary lines or their center lines, other similar right-of-way lines or lot lines or boundaries of subdivisions or municipal boundary lines, all as shown on the § 190-7 are hereby established as shown upon the duly adopted Zoning Map. Where a district boundary line does not follow such a line, but is shown parallel to such a line on the § 190-7 are hereby established as shown upon the duly adopted Zoning Map, the distance between the parallel lines shall be as dimensioned on the § 190-7 are hereby established as shown upon the duly adopted Zoning Map. Such dimensions shall be construed to read from the outside edge of all rights-of-way rather than from their center lines.
  3. Where the street layout actually on the ground varies from the street layout as shown on the § 190-7 are hereby established as shown upon the duly adopted Zoning Map, the designation shown on the mapped streets shall be applied in such a way as to carry out the Building Inspector's judgment as to the purpose and intent of the § 190-7 are hereby established as shown upon the duly adopted Zoning Map for the particular area in question.
  4. When the location of a district boundary line cannot be otherwise determined, the determination thereof shall be made by the Code Enforcement Officer by scaling the distance on the § 190-7 are hereby established as shown upon the duly adopted Zoning Map from a line of known location to such district boundary line.
  5. In the case of uncertainty as to the true location of a district boundary line in a particular instance, an appeal may be taken to the Board of Appeals, as provided in Article XII.
  6. When a district boundary line divides a lot in a single ownership at the effective date of this chapter or any subsequent amendment thereto, the Board of Appeals may permit an extension into one district of a lawful conforming use existing in the other district, as hereinafter provided in § 190-131A.

§ 190-9. District use regulations.

Within any district, a building, structure or lot shall only be used for one of the uses indicated in the Tables of Use Regulations,EN for the specific district in which it is located on the Zoning Map, and in accordance with the particular classification of that use in that district. Further, any such building, structure or lot shall only be utilized in conformance with the provisions of the Tables of Dimensional Regulations. In addition, such use shall comply with all other applicable provisions of this chapter.
